How can we help?

    Determining Negligence

Individuals and companies act responsibly most of the time.  However, there are times that their guard is let down, and they become irresponsible.  When that happens, people may sustain injuries or even die as a result.  An individual or company neglecting responsibility is the ground level of negligence.

Lawyers tend to define negligence as the failure of a person or company to exercise reasonable care that results in an injury or death to another person.  Negligence can result in injuries or death to people in a variety of ways, including workplace accidents, car accidents, slip and fall accidents, medical malpractice, defective products, and more.

The victim of another person or company’s negligence can take legal action against the negligent party seeking financial compensation.  Were you injured?  Do you believe a negligent person or company caused your injuries by being negligent?  The Carrollton negligence attorneys of The Parian Law Firm, LLC have filed lawsuits for clients all over Georgia, and we are here to help you get the financial compensation you deserve!

    How Do You Prove Negligence?

Injury victims have to prove that a person or company neglected to exercise the care that another reasonable person or company would have under similar circumstances.  The definition can be broken down into four distinct elements

Four Elements an Injury Victim Must Prove to Win a Negligence Claim

    1. The Responsible Person or Company Owed a Duty to the Injured Person or the Public in General
    2. The Responsible Person or Company Violated that Duty
    3. The Violation of the Duty Caused the Injury
    4. There is an Actual Injury to the Victim

An example would be when a driver runs a stop sign and collides with another car causing injuries. The driver owed a duty to the public to stop at the stop sign.  The driver did not stop; therefore, he or she violated that duty.  The collision that was caused by the driver running the stop sign caused injuries to people in the other car.  In this instance, you have proven all four elements of negligence.
