    Will Georgia Workers’ Comp Pay Me for My Pain and Suffering?

    When you get hurt on the job, Georgia workers’ compensation benefits can help you with some but not all of your medical costs and lost wages. But doctor’s bills and missing paychecks may not fully reflect what you’ve lost after a work injury. The pain and suffering that you experience after an on-the-job accident can be just as real as any visible injury, and may have just as large an impact on your day-to-day life and ability to work.

    But don’t expect workers’ compensation to provide you with any relief.

    Compensation for “pain and suffering” is not available under Georgia’s – or any other state’s — workers’ compensation programs. However, that does not necessarily mean that recovering pain and suffering damages for a work injury is entirely out of the question.

    While you can’t generally sue your employer for injuries you suffered at work, you may have claims against other parties if they were responsible for your injuries. Situations in which injured Georgia workers may have claims for damages, including damages for pain and suffering, against third-parties include where the injury was caused by a defective or unreasonably dangerous machine or piece of equipment in the workplace. In such cases, the manufacturer of the machine could be held responsible.

    Similarly, the manufacturer of a toxic substance could be sued if the substance was the cause of the injury. If a third-party, such as the driver of another car or the owner of property you were at during the course of your employment, is at fault for your accident, damages may be recoverable from them as well.
