Records for a Personal Injury Case

Records Needed for Personal Injury Lawyer Meeting

Our clients describe the moments after an accident as confusing, hectic, and overwhelming.  One of the common questions we hear from accident victims is “Did I do everything I should have done after my accident?”  There is no real “right” answer to that question.  However, there are some things to keep in mind should you suffer an injury in the accident.

Accidents come from different causes.  There are car accidents, trucking accidents, motorcycle accidents, slips and falls, work accidents, etc.  Likewise, injuries suffered in accidents can be different.  Many lucky people walk away with no injuries from their accident while others suffer lifelong injuries or death.

Personal injury cases are built by facts provided to your attorney.  There are facts provided by accident victims or their families.  Other facts are “uncovered” by your personal injury attorney properly working up your case.  The more facts you provide to your attorney, the better your attorney will be able to support your case and maximize your recovery.

Here are some examples of facts you can keep up with to help your lawyer build the case:

    How Did the Accident Happen?

    • Tell the truth to the police.  Write down everything you tell the police officer while it is fresh in your brain.
    • Get names and contact information (cell phone number & email) for ALL witnesses to the accident.
    • Take out your cell phone or have someone else take out their cell phone to take pictures of the scene.  Pictures should include anything that is believed to have been involved in your accident.

Did You Get Medical Attention After the Accident?

    • Injuries can take the time to show up.  The safest bet is to seek medical care within 24 hours after the accident.
    • NEVER misrepresent your injuries to any doctors or emergency personnel.
    • NEVER minimize your injuries either!!!
    • Document, document, document all of your medical care expenses.  Trust us…..they will send you a bill!
    • Don’t settle your claim until you have reached maximum medical improvement and your doctor has released you, in writing, from any further treatment.

Did the Accident Affect Your Life?  Have Any Pain and Suffering?

    • Write down your pain level daily.  1 through 10.  1 is little to no pain.  10 is you are on fire…….literally.
    • Write down what sports, hobbies, or other activities can you no longer do after the accident.
    • If your job has changed due to injuries from the accident, write that down as well.
    • Be honest about your damages to show you are not trying to “work the system.”

This is not a full list.  Use these suggestions to get started.  The best course is to contact a personal injury attorney that ONLY represents accident injury victims.  Many lawyers advertise for such, but they do not specialize in personal injury.
