When we decide to move into a nursing home or assisted living facility, or when we help a loved one make such a move, we’re not doing so because we’ve always wanted to live in a place with a comfortable rec room. We do so because we are counting on the facility and its staff to care for us or our loved one; to put their health and well-being first; to treat the seniors in their care with dignity and respect.

Sadly, and all too often, nursing homes and their employees breach the trust that has been placed in them. According to the National Center on Elder Abuse:

During a two-year period, nearly 1 in 3 U.S. nursing homes were cited for violations of federal standards that had potential to cause harm or that had caused actual harm to a resident and nearly 1 out of 10 homes had violations that caused residents harm, serious injury, or placed them in jeopardy of death.
In a study of 2,000 interviews of nursing home residents, 44% said they had been abused and 95% said they had been neglected or seen another resident neglected.
Over 50% of nursing home staff admitted to mistreating (e.g. physical violence, mental abuse, neglect) older patients within the prior year in one study. Two thirds of those incidents involved neglect.
These are outrageous statistics. How can this happen? Sometimes, nursing homes are poorly staffed or understaffed, leaving seniors neglected. In other cases, caregivers lack adequate training or don’t possess the medical knowledge, interpersonal skills, and temperament required to care for the elderly.

Whether due to a lack of resources or overt acts of abuse, the problems and indignities that can be suffered by nursing home residents are many. They include acts or failures to act that can lead to serious adverse physical and psychological consequences. These include:

    • Medication errors
    • Wrongful death
    • Bedsores
    • Physical and psychological abuse
    • Financial misconduct, fraud, and theft
    • Malnutrition
    • Sexual abuse
    • Falls and drops
    • Dehydration
    • Inadequate care for Alzheimer’s disease and dementia
