Lies Told About Personal Injury Lawyers! | The Parian Law Firm, LLC | Cade Parian

Who out there has ever heard (or told for that matter) a personal injury lawyer joke?  I am willing to bet that 99% of you are nodding your heads affirmatively.  Let’s face it.  Personal injury lawyers rank up there with “Yo Momma” and “Knock Knock” on the joke spectrum.  This creates a certain mystique around our profession that causes many to question the legal profession and process as a whole.  My goal in this article is to address some of the LIES that you hear about personal injury law and personal injury lawyers.  This does not apply to ALL personal injury lawyers so be vigilant and SMART about who you hire to represent you or your loved ones.

(1)  “All those Personal Injury Lawyers Want is Some of Your Money!” – The age-old piece of the pie joke.  However, I will tell you that the vast majority of personal injury lawyers out there DO WANT ONE THING.  That one thing is justice for their clients.  Think about it for a minute.  Personal injury lawyers puts their money, time, reputation, blood, sweat, and tears into making sure that you are not taken advantage of by insurance companies, shrewd businesses, and a host of other possible defendants.  In essence, personal injury lawyers become your voice in the legal system.

(2)  “Personal Injury Lawyers Will Cost You Big Time Dough!” – There are certainly some lawyers out there that cost about $1,000 for an hour’s worth of time.  They generally represent the big corporations and insurance companies that are usually defendants.  Personal injury lawyers (nine times out of ten times) do not cost you an out-of-pocket dime.  Personal injury lawyers front the expenses associated with litigating your case.  Those expenses and the legal fees associated with representing you are taken out of your settlement and/or award at the completion of representation.  The percentage of legal fees (i.e. the “attorney’s take”) is agreed upon before personal injury lawyers ever begin representing you.

(3)  “It Was Just a Little Fender-Bender!” – Folks, those little fender-benders can turn into major headaches down the road.  What you may think you can handle on your own is not usually what it seems.  For example, I represented a young college girl who was rear-ended at a stop light in Atlanta, Georgia.  At the scene of the accident, a small scratch was barely visible on her rear-bumper.  She called her father, and he told her to have it fixed at XYZ Body Shop.  The insurance company sent a check to her father, and he signed a full release of liability to the insurance company.  Two Weeks after the accident, my client awoke in the middle of the night with severe burning pain running from her right ear down her neck.  She could not turn her head to the right.  Come to find out, she had a severely herniated disc in her neck that was causing near paralysis of the nerves exiting the spinal cord.  We were able to salvage some insurance coverage, but it was a nasty fight.  The father admitted that he made a mistake in marginalizing the accident, and next time he said he would call a personal injury lawyer prior to signing anything from an insurance company.
